Michael Jordan Tells Court He Felt No Fear of the Racing Body in Antitrust Trial

Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his competitive side and status as a newcomer motivated his push for 23XI Racing to confront Nascar over alleged violations of competition laws.

Team Investment and a Will to Win

The owner disclosed financial and corporate details of his racing venture, saying he invested $40m of his own funds into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”

The Core Dispute: Franchise System and Renewal Demands

At issue is the expiration of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other major leagues with separately owned franchises, such as the NBA’s Hornets or the NFL’s Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.

Jordan testified for about sixty minutes and left the court to a media frenzy, with fans and media vying for a view or a photo of the sports legend.

Spearheading the Fight

23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan contended is unlawful to keep two hands on the wheel.

For Jordan and and Heather Gibbs, who testified before Jordan, are events from last September. Gibbs described a frantic and emotional period where the racing circuit told teams they had to sign a charter agreement extension. This agreement consists of 112 pages outlining team compensation and a guaranteed entry in Nascar-sponsored races.

Choosing Litigation

Jordan explained that 23XI and Front Row Motorsports decided their sole viable path was to decline to sign that 112-page package and litigate the matter. All other teams signed the agreement.

Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or negotiations. Nascar refused to engage, according to his testimony.

The Ultimate Motivation: Winning

But in the end, the resistance against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Success.

“Denny convinced me getting a third driver improved our chances to win,” he testified, sharing that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I dove in.”

Account from the Gibbs Family

Gibbs described her push for indefinite franchises, which she said a formal letter to Nascar. She said the pressure of the signature deadline didn’t sit well.

According to her, the team founder first attempted to call and persuade Nascar against demanding signatures, but CEO Jim France declined the request.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s executives. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
